About the conference
The beginning of the 21st century marks a turnabout in the way the relations between human beings and the world of goods. Ideas about the abundance of natural resources, and thus of exclusivity of rights to use the product of these resources, is shifting towards an awareness that the resources are limited and the need for responsible use of these.
Property law is shifting along with these societal developments. Property law determines our relationship with goods. The idea of absolute exclusivity, which was predominant at the beginning of the 19th century, is regressing at the beginning of the 21st century. The idea of abundance for those goods which are not subject to exclusive property rights has also been abandoned. The tragedy of the anti-commons leads to an unsustainable relationship with the world of goods. The lack of conceptual limitations on using natural resources can also negatively impact the long-term viability of the world.
The question arises whether new property law legislation incorporates these changed views on property relations. Several law reforms have enacted a new property laws over the last decades, such as the new property law enactments in the Belgian Civil Code (2020) and the Chinese Civil Code (2020), but also the Argentinian Civil Code (2015), the Civil Code of Hungary (2013), the Romanian Civil Code (2009) etc. The question arises whether these (and other law reforms) demonstrate further developments concerning the earlier generation of law reforms of the second half of the 20th century, such as the Dutch Civil Code (1992) and the Quebec Civil Code.
